Protecting the privacy and Personal Data of our users is of utmost importance to QUANDELA. QUANDELA is collecting and processing personal data in compliance with the General Data Protection Regulation (GDPR) put in place by the European Commission since May 25th, 2018 and with the French personal data regulation including the law n° 78-17 of 6 January 1978 as amended and the law n° 2018-493 on the protection of personal data (hereafter designed as “Data Protection Regulation”).

QUANDELA does not collect information that personally identifies you as an individual except when you provide such specific information on a voluntary basis. There may be occasions where specific Personal Data (Name, Email, Phone Number, Company) are requested before you can enter certain sections of QUANDELA’s website as part of the registration process for the Services, or as part of your continued use of the Services. In all such cases, QUANDELA will collect only Personal Data that is voluntarily provided by you and undertakes that such information will be kept strictly confidential.

Your personal data will never be made public or disclosed to unknown parties. They will be processed by a limited number of persons, specially authorised by QUANDELA:
Within QUANDELA , your data will only be processed by persons within the company for whom it is necessary in order to carry out their duties. These persons are bound by an obligation of confidentiality and have been trained to prevent any loss, destruction, inappropriate access or unauthorised use of your personal data.
Third party service providers. We use other companies to perform certain activities on our behalf and to provide our services to you, such as payment processing, support cases management and customer relationship management. These suppliers only have access to the personal data required to carry out the tasks entrusted to them and are contractually bound to respect confidentiality in order to comply with the instructions provided by QUANDELA, in addition to the applicable legislation on the protection of personal data.
Professional advisers such as lawyers, bankers and auditors who provide advisory, banking, legal, insurance and accounting services.
Third parties. Your personal data may also be disclosed to a third party in the event of a reorganisation, merger, sale, assignment or transfer of all or part of our business, assets or securities (including in connection with any bankruptcy or similar proceedings).

The data collected may be communicated to public entities or authorities, supervisory and control authorities and, more generally, to private or public legal entities in their capacity as a public officer or representative of the public authority in order to: (a) respond to a request from a public or administrative authority, (b) comply with the requirements of the law or legal proceedings or (c) protect or defend our legal interests or our property, our Site or our customers.
We may share your personal data with service providers acting as processors who may be located outside the European Economic Area (EEA), which involves the transfer of your personal data outside the EEA.
In these circumstances, QUANDELA will ensure that your personal data is transferred to countries whose level of personal data protection has been deemed adequate by the European Commission or, if this is not the case, QUANDELA will take contractual safeguards (such as the adoption of contractual clauses approved by the European Commission) signed with the party receiving the data.
Your personal data are only retained for as long as strictly necessary to fulfil the purposes for which they are collected and processed, in particular to offer you the Services. The nature of the data and the purpose for which it was collected determine the appropriate retention period:
For subscribed users to QUANDELA offers, account information (login and email address, company information) is stored for as long as the service is provided and deleted after five (5) years of inactivity.
Computation data (see Article 11) is stored in user workspace and is destroyed upon account removal.
Anonymous navigation and traffic information are stored for thirteen (13) months (see chapter 2A).
Personal Data for a prospect that does not respond to any solicitation may be retained for three (3) years.
However, this does not prevent your data being kept in an intermediate archive separate from the active database, with restricted access, insofar as there are specific legislative or regulatory provisions, for example, to meet accounting, social or tax obligations, or if the data is of interest in the event of litigation, justifying keeping it for the duration of the applicable statute of limitations/forclosure rules.
Any Personal Data you submit through QUANDELA’s websites will be held in the strictest confidence. To ensure this, all forms on our websites that send Personal Data to a database that may be used in the future (e.g. mailing lists, registration, etc.), have check boxes where you specify whether or not you would like to receive information from us in the future. Forms used just to send emails, post messages, etc., do not include the option, but will never be used to send information. If you choose to receive information from us, each message will also include instructions on how to “unsubscribe” from future mailings should you wish to cancel.
QUANDELA complies with the principles of the General Data Protection Regulation (GDPR) put in place by the European Commission since May 25th, 2018.
In accordance with the Regulation, QUANDELA identifies all the processing operations carried out in a record of processing activities that we leave at the disposal of the CNIL (French Supervisory Authority).
QUANDELA has implemented technologies and put in place physical, electronic and managerial procedures to ensure the confidentiality, integrity and security of the processing of Personal Data and protect the stored Personal Data against accidental or unlawful alteration, unauthorized disclosure or access or improper use. QUANDELA’s employees, processors or any other person acting under the authority of QUANDELA as controller, who have access to Personal Data, are obliged to respect your privacy and the confidentiality of your Personal Data.
QUANDELA will not sell, make available to, or share Personal Data relating to you with, third parties without your consent, unless (i) required to do so by law or by judicial order or (ii) if QUANDELA in good faith believes that such action is necessary to (1) comply with the law or with legal process; (2) protect and defend QUANDELA’s rights and property; (3) protect against misuse or unauthorized use of the Services; or (4) protect the personal safety or property of QUANDELA’s users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions).
You have the following rights in relation to your Personal Data:
A right to be informed: you are entitled to access your Personal Data and obtain a copy.
A right to rectify: you are entitled to have your Personal Data rectified if inaccurate, incomplete or out-dated.
The right to erasure: you may invoke the right to have your personal data deleted if it is no longer necessary for the purposes of our processing, if your consent or your opposition to one or more processes is revoked, if the processing is deemed unlawful, or if a legal obligation requires the deletion of this personal data.
A right to object , on legitimate grounds to the processing of your Personal Data. You also have the right to object, on request and free of charge, to the processing of Personal Data that QUANDELA anticipates being processed for the purposes of prospection marketing.
Right to withdraw your consent at any time: where processing is based on your consent (e.g. marketing prospecting), you may withdraw your consent at any time. However, this will not affect the legality of previous processing.
A right to cancel or limit the processing of your Personal Data, which entails that in certain cases you can request us to temporally suspend the processing of the data or that we keep them longer than necessary when you may need it;
A right to provide instructions regarding the storage, deletion or disclosure of your personal data after your death;
A right to request the portability of your personal data: you are entitled to receive the personal data that you made available to us in a structured, commonly used and machine-legible format, to be able to transmit them to another entity directly.
You may exercise your rights free of charge by sending to us an e-mail (to a single e-mail address dataprotection@quandela.com), simply informing us of the reason of your request and the right that you wish to exercise.
If there is any doubt about your identity, we may need to ask you for additional information to help us confirm your identity and ensure that you can exercise your rights. We may also contact you to request further information about your request in order to speed up our response.
We aim to respond to all legitimate requests within one month. Our response may sometimes exceed one month if your request is particularly complex or if you have submitted several requests. If this is the case, we will let you know and keep you informed.
Finally, we inform you that you have the right to file a claim before the responsible data protection regulatory authority, in particular, before the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés).
The data that you send for computation with our online services is stored in user workspace not shared to any of our customer nor third party. Raw data computation and computation output is stored only for the necessary purpose of generating the computation and providing the service. Quandela might process the raw data for statistics reason and improvement of the quality of the processing.
